Linden has worked with Keats McFarland & Wilson since 2005 concentrating her practice on all areas of intellectual property, with an emphasis in trademark, copyright and patent infringement litigation and enforcement. In addition, Linden also has experience in class action litigation involving Internet commerce.
Her experience includes all phases of litigation, including pleading, discovery, motion practice and trial. Linden has been involved in obtaining temporary restraining orders, preliminary injunction orders, default judgments, contempt sanctions, case-dispositive discovery contempt sanctions, civil incarceration contempt sanctions, prejudgment bond and ex-parte seizures and impoundment of counterfeit goods and asset freeze orders.
Linden has also gained significant transactional experience by handling numerous entertainment matters and counseling involving famous characters, products, feature films, brand development and merchandising, and writer and actor deals.
Linden’s work in trademark enforcement, promotion and counseling includes clearance, licensing, federal court litigation of trademark infringement, dilution and breach of license agreements. Linden’s trademark prosecution experience includes all areas of United States Patent and Trademark Office proceedings.
Her intellectual property experience encompasses addressing virtually every type of intellectual property issue raised by the Internet, including right of publicity, privacy rights, Internet infringement and website protection, recovery of domain names, including through ICANN Uniforn Domain-Name Dispute Policy proceedings, and drafting website agreements.
Linden has also worked extensively with United States Border and Customs officers concerning the identification, detainment and seizure of counterfeit products and has been involved with drafting exclusion notices, and researching and drafting a White Paper to increase U.S. Customs ability to enforce the anti-counterfeiting of patents.
Linden graduated from Northeastern University School of Law where she concentrated her studies in Entertainment and Intellectual Property Law, specifically studying Copyright, Trademark, Music Law and Publishing, and Film Development, Production and Distribution. During law school, Linden worked for Warner Bros. in the music theatrical and litigation department, Screen Actors Guild and Houghton Mifflin. In 2005, Linden also volunteered for Lawyers for the Arts where she assisted in the protection of artists’ rights and the development of their annual Film Seminar.
Linden’s interest in Entertainment and Intellectual Property began prior to law school when she attended University of Southern California’s acclaimed School of Cinema-Television. While in film school, Linden studied the fundamentals of film-making gaining extensive knowledge of film development, production, post-production, distribution and marketing. She also worked as an accounting clerk for Rob Zombie’s House of 1000 Corpses and HBO’s Live From Baghdad.
Linden is a member of the State Bar of California and is admitted in the Central, Southern, Northern and Eastern United States District Courts for California. She is also a member of the Beverly Hills Bar Association and the Los Angeles County Bar Association.
