Philips Receives $12.8 Million Jury Verdict in Final Judgment

U.S. Philips Corporation v. International Norcent Technology, et al.,

Case No. CV 06-01366 ER (PLAx) (C.D. Cal. 2007)

Philips filed suit in the United States District Court for the Central District of California against International Norcent Technology, Norcent Holdings, Inc., Shanghai Hongsheng Technology Co., Ltd., Hongpu International Development Co., Ltd. and Jennifer Long, for their willful infringement of Philips’ intellectual property rights in its patented DVD technology.

Based on Philips’ efforts, the Court entered a judgment (jury verdict) award of approximately $12.8 million for Philips against the U.S. entities and individual.

Philips is seeking enhanced damages and attorneys’ fees in addition to the $12.8 million award.

TO ALL PARTIES AND COUNSEL OF RECORD:

The jury having returned its verdicts in this matter, 1 the Court hereby enters
final judgment in favor of Plaintiff U.S. Philips Corporation (“Philips”) and against
Defendants International Norcent Technology (“Norcent Technology”), Norcent
Holdings, Inc. (“Norcent Holdings”), and Jennifer Long (“Long”) that:

1. Defendant Norcent Technology has directly infringed, has induced
infringement, or has contributed to infringement of Claims 1 and 6 of United
States Patent No. 5,677,903 (“the ‘903 patent”), and Claims 9 and 12 of United
States Patent No. 5,463,607 (“the ‘607 patent”); and such infringement was
willful.
2. Defendant Norcent Holdings has directly infringed, has induced infringement,
or has contributed to infringement of Claims 1 and 6 of the ‘903 patent, and
Claims 9 and 12 of the ‘607 patent; and such infringement was willful.
3. Defendant Long has directly infringed, has induced infringement, or has
contributed to infringement of Claims 1 and 6 of the ‘903 patent, and Claims 9
and 12 of the ‘607 patent; and such infringement was willful.
4. Claims 1 and 6 of the ‘903 patent, and Claims 9 and 12 of the ‘607 patent are
not invalid.
5. As a result of Norcent Technology’s, Norcent Holdings’, and Long’s
infringement of the ‘903 and ‘607 patents, Norcent Technology, Norcent
Holdings, and Long are jointly and severally liable for and shall pay Philips
compensatory damages in the amount of $12,853,793.
6. Defendants Norcent Technology’s and Norcent Holdings’ Counterclaims 1
through 6 are hereby dismissed with prejudice.

1Philips intends to file subsequent papers requesting a permanent injunction,
enhanced damages, attorneys’ fees, and pre-judgment and post-judgment interest.

7. Defendant Long’s Counterclaims 1 through 4 are hereby dismissed with
prejudice.
8. The Court reserves jurisdiction over all issues of the present case, including
without limitation, enforcement of this Judgment. All present orders remain in
effect unless otherwise provided by the Court.
9. The Court reserves its right to amend this Judgment to include further relief for
Philips that the Court may deem appropriate. Such relief may include, without
limitation, pre-judgment and post-judgment interest, and relief under 35 U.S.C.
§§ 283, 284, and 285, which provide for the Court to enter permanent injunctive
relief, to enhance the damage award, and to grant attorneys’ fees.

 

JUDGMENT IS ENTERED.

 

IT IS FURTHER ORDERED that the Clerk of the Court shall serve, by United States
mail, copies of this Entry of Judgment on counsel for the parties in this matter.
